Residential Expert Witness

We have extensive experience in preparing reports for Housing Disrepair disputes and are regularly appointed on behalf of Landlords and Tenants, in certain cases instructed by both parties as Single Joint Expert, and we pride ourselves on producing clear, concise and impartial CPR (Part 35) compliant reports. 

Independent Expert Reports

As an Expert Witness, we have a duty to the Court and must provide an independent and unbiased report. An Expert Witness Report is prepared for the benefit of the Court in matters that we are deemed to be experts in, and it must adhere to the Civil Procedure Rules.


Our RICS Chartered Surveyors are experts in their field and are fully conversant with the Civil Procedure Rules (Part 35), the accompanying Practice Direction and all relevant statutory legislation:


  • The Homes (Fitness for Human Habitation) Act 2018
  • Landlord and Tenant Act 1985, Section 11
  • The Defective Premises Act 1972 
  • The Housing Act 2004 

The Report Process

Upon receipt of instruction, our involvement is normally as follows:


  • Inspect the alleged defects in the property. 
  • Provide a CPR (Part 35) compliant report, detailing the Surveyor's professional opinion on the cause of any disrepair and the remedial work required to put the property back into repair. The report will include photographs and a Scott Schedule. 
  • Facilitate joint meetings and discussions with other Expert Witnesses for the preparation of Joint Expert Statements, where required. 
  • Attend Court hearings to give evidence, where required.
